1. Definitions

In these Terms and Conditions, the following terms apply:

• "Service" refers to the yacht tour departures and related services offered by Keelward.
• "User" or "Guest" means any individual who uses this website or books a Keelward departure.
• "We", "Us", "Our" refers to Keelward, operating from Seremban, Negeri Sembilan, Malaysia.
• "Agreement" means these Terms and Conditions as accepted by the User.
• "Content" includes all text, images, and materials on the Keelward website.

2. Acceptance of Terms

By using this website or enquiring about or booking a Keelward departure, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you should not use our website or services.

You must be at least 18 years of age and have the legal capacity to enter into this Agreement. Guests under the age of 18 may participate in departures when accompanied by a responsible adult who has accepted these Terms on their behalf.

3. Description of Services

Keelward provides yacht tour departures from the Negeri Sembilan coast of Malaysia, including but not limited to the Quiet Waters Half Day, Full Day Reef and Shore, and Three-Day Southern Islands Trail. Service availability is subject to weather conditions, vessel availability, and minimum participant numbers.

All departures operate under the oversight of the Department of Marine, Malaysia, and are subject to applicable Malaysian maritime regulations.

4. Bookings and Reservations

Bookings are confirmed upon receipt of deposit as agreed with Keelward via direct communication. A booking is not confirmed until Keelward has issued a written confirmation by email.

• Deposits are non-refundable unless a departure is cancelled by Keelward.
• Full payment is typically due no later than seven days before the departure date, as confirmed in writing.
• Guest capacity on each vessel is strictly limited to eight persons per departure.

5. Cancellations and Rescheduling

Cancellation by Guest: Cancellations made more than 7 days before the departure date will receive a full refund minus the non-refundable deposit. Cancellations within 7 days of departure are generally not eligible for a refund, though Keelward may apply a credit toward a future departure at its discretion.

Cancellation by Keelward: Keelward reserves the right to cancel or postpone any departure due to adverse weather conditions, technical vessel issues, or other circumstances beyond our reasonable control. In such cases, guests will be offered a full refund or rescheduled departure at their choice.

6. User Responsibilities

Guests are expected to:

• Follow all safety instructions given by the crew before and during the departure
• Disclose any medical conditions, mobility limitations, or allergies relevant to the trip prior to departure
• Behave in a manner respectful of other guests, the crew, and the marine environment
• Not consume alcohol to excess or use substances that may impair safety on board
• Follow crew instructions regarding reef behaviour and environmental protocols

Keelward reserves the right to refuse participation or to remove a guest from a departure if their behaviour poses a risk to safety or significantly disrupts the experience for others.

7. Intellectual Property

All content on the Keelward website — including text, images, itinerary descriptions, and branding — is owned by Keelward or used with appropriate permission. You may not reproduce, distribute, or use this content commercially without prior written consent.

8. Payment Terms

All prices are quoted in Malaysian Ringgit (MYR) and are per person unless otherwise stated. Prices include the services described in the departure listing. Payment methods accepted are communicated directly during the booking process.

Keelward does not collect credit card information through this website. Payment arrangements are handled securely outside the website enquiry form.

9. Disclaimers

Keelward's yacht tours involve maritime activity. Participation carries inherent risks associated with being at sea, including but not limited to motion sickness, changes in sea conditions, and exposure to sun and wind. By booking a departure, guests acknowledge and accept these inherent risks.

Keelward does not warrant specific marine wildlife sightings, reef conditions, or weather outcomes. Itineraries may be adjusted based on conditions on the day of departure.

10. Limitation of Liability

To the fullest extent permitted by Malaysian law, Keelward's total liability to any guest shall not exceed the amount paid by that guest for the relevant departure. Keelward shall not be liable for indirect, consequential, or incidental losses arising from participation in its services or from use of its website.

11. Indemnification

You agree to indemnify Keelward against any claims, losses, or expenses arising from your breach of these Terms, your misuse of the website, or your conduct during a departure that results in harm to Keelward, other guests, or third parties.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of Malaysia. Any disputes arising from or connected with these Terms shall first be subject to good-faith direct discussion between the parties. If not resolved within 30 days, disputes shall be referred to mediation before the Malaysian Mediation Centre, and thereafter to the courts of Malaysia.

13. Changes to These Terms

Keelward may update these Terms from time to time. Changes will be published on this page with a revised "Last Updated" date. Continued use of the website or booking of services after changes are published constitutes acceptance of the updated Terms.
